Postconviction Relief

Following a conviction, and direct appeal, relief from a criminal conviction is still possible. Some of the issues raised in postconviction motions relate to whether the representation provided by the trial counsel or appellate counsel was constitutionally effective, as well as whether the sentenceĀ imposed is actually legal. Rocco J. Carbone, III has experience filing motions in the trial court, and briefs in the appellate courts, regarding issues arising fromĀ  Florida Rules of Criminal Procedure 3.800 and 3.850 and federal 2254 and 2255 motions to seek postconviction relief.
